Refund Policy
1. General Provisions
1.1. This Refund Policy describes the terms and procedure for refunds of payments made for paid plans of the SmartSplitAI Contract Review service (the "Service").
1.2. SmartSplitAI is intended for legal entities, individual entrepreneurs, and other persons using the service for professional or entrepreneurial purposes. If mandatory provisions of applicable law grant additional rights to a specific user, this policy does not limit them.
1.3. This policy does not limit any mandatory rights granted to the client by applicable law, where such rights extend to the relevant relationship.
2. Plans and Nature of the Service
2.1. The Service offers the following paid plans:
- One-time review — one contract review, valid for 90 days from the payment date. Not a subscription. Does not auto-renew.
- Time-limited packages — a fixed number of reviews per month, valid for 30 days from the payment date. Not subscriptions. Do not auto-renew. Unused reviews do not carry over after expiration.
- Freemium — free plan with limited functionality. Creates no payment obligations.
2.2. The service is deemed delivered at the moment the analysis is completed and the report becomes available to the user in the Service interface.
3. Request Deadline and Procedure
3.1. A refund request may be submitted within 14 (fourteen) calendar days from the payment date. This period is voluntary and does not limit mandatory rights provided by applicable law.
3.2. Requests must be sent to info@smartsplitai.net. The request should include: the email associated with the account; the payment date and amount; the plan or review identifier (if known); the reason for the request.
3.3. The Service reviews the request within 10 (ten) business days and notifies the user of the decision.
4. Refund Before Use
4.1. If no review within the paid plan has been initiated, the user may request a full refund.
5. Partially Used Package
5.1. After at least one review has been used, a standard proportional refund for the remaining reviews is not provided.
5.2. Exceptions where a refund may be considered on a case-by-case basis:
- a technical malfunction of the Service that affected the ability to use the reviews;
- an erroneous double charge;
- an erroneous payment (wrong plan, wrong amount);
- mandatory requirements of applicable law;
- an individual decision by the support team.
6. Technical Analysis Error
6.1. If, for technical reasons, the analysis did not produce a usable result (error status):
- A free retry of the analysis is performed first, at no additional charge.
- If the retry also does not produce a usable result, the user may request a refund.
6.2. The retry does not create a new charge, does not consume the tariff, and does not send a duplicate notification.
6.3. The Service does not promise an automatic refund if a usable result has already been provided.
7. Erroneous Double Charge
7.1. In the event of an erroneous double charge of the same amount, the user may request a refund of the overpaid amount. Such requests are prioritized.
8. Refund Method
8.1. Refunds are issued to the original payment method. The crediting time depends on the payment provider and the issuing bank.
8.2. For ruble payments: refund to the bank card or account from which the payment was made.
8.3. For euro payments via Paddle:
- Paddle acts as the Merchant of Record for EUR payments processed through it;
- a request may be submitted through SmartSplitAI or the channel provided by Paddle;
- SmartSplitAI provides information about the service delivered;
- refund processing and execution are subject to Paddle's rules and obligations;
- this Policy does not override the Paddle Buyer Terms.
9. Chargeback
9.1. Upon receiving a chargeback, the Service may temporarily suspend: the use of paid unused reviews; new paid transactions.
9.2. Until the dispute is resolved, the Service may not: delete the account; delete documents and results; block access to already paid and undisputed data; declare the user a violator.
9.3. The chargeback procedure is governed by applicable law and the payment provider's rules.
10. Access Termination After Refund
10.1. Upon approval of a refund, access to the corresponding functionality and unused reviews of the paid plan is terminated.
10.2. Previously generated reports remain accessible if the account is active.
11. Policy Changes
11.1. The Service may amend this Policy. The new version takes effect upon publication.
11.2. Payments made before the new version takes effect are governed by the terms in effect at the time of payment.
